SLA - Service Level Agreement
MyVPSHost wishes to provide our clients, affiliates and resellers
with a positive online experience. To accomplish this, all associated
with us must follow the same rules and guidelines. These policies
(TOS, AUP, and SLA) are intended to maintain MyVPSHost’s high
quality of service and make this available to all on a fair, consistent
and efficient basis. By accepting service from MyVPSHost, you acknowledge
your acceptance to be bound to these policies. If you do not agree
to these policies you must either contact us and we may come to
an agreement or you may have to terminate your account.
General.
•
The client, customer or end user is the person or entity
who is applying to receive or is receiving services or goods from
MyVPSHost.
• MyVPSHost understands the
importance of server availability to our customers and is committed
to providing services at a standard of excellence commensurate
with the best practice in the industry.
•
Parties involved with the online services of MyVPSHost
include the Colo4Dallas Datacenter, Authorize.NET, Kayako Web
Solutions and ModernBill. Other smaller parties maybe involved
intermittently with smaller developments or projects.
• The end user agrees to accept
the services of these parties when creating an account or receiving
services from MyVPSHost.
•
To create a successful experience both the supplier MyVPSHost
and the end user must adhere to certain responsibilities.
• As a supplier of online
services we will insure that all of our promises are met to the
satisfaction of our clients.
• As an end user you must
agree to our terms upon signing up for services from MyVPSHost
and maintain this agreement through the course of the service.
•
All fees, services and periods are clearly advertised
on our web site and related publication materials.
• Fees will not change unless
otherwise stated before billing commences.
•
Both MyVPSHost and the end user will have access to all
information required to fulfil their service requirement.
• MyVPSHost must collect end
user information for accounts, billing and setup of services.
We will provide any information to the end user that is rightfully
there own and provide resources to help maximise the use of our
services.
• The end user will have access
to all invoices, receipts, instructions, guides, tutorials and
any other resource based information.
•
We encourage all clients to submit feed back to MyVPSHost
so that we may improve our services and or advertise to potential
clients.
• Methods for submitting feed
back include on our web site, phone conversations, emailed and
faxed suggestions or praises.
•
MyVPSHost will ensure that after sales service will be
provided and maintained throughout the course of services being
required by the end user. This will include solutions to support
requests, regular system checks, system maintenance and problems
solved as soon as possible.
• If any network outages occur
or scheduled downtime is planned the client will be notified via
email of the dates and times. Outages and downtime is defined
as a period in which 100% packet loss to our network is experienced,
caused by a problem in MyVPSHost ’s network.
• We aim to provide 100%
uptime but this is impossible to achieve in real life scenarios
due to upgrades, repairs, domain delegation and other related
issues. We guarantee 99.9% uptime which is just under 45 minutes
downtime per month. We cannot be held liable for upstream problems,
outside of our network.
• We will refund 5% of the
monthly fee for each hour of downtime up to 100% of the monthly
fee. Network downtime is measured from the time the network
is 100% unreachable until the service is one again restored.
In order to receive a credit the client must fill out a downtime
violation report within 7 days of the reported downtime. Credits
will not be given where the downtime was scheduled, was not
100% MyVPSHost’s fault or the downtime was caused by the
client.
• If you aren't satisfied
with your web hosting solutions for any reason, you may cancel
your account within thirty (30) days of your account creation
date and recieve a full refund.
• MyVPSHost's
services, commitments and responsibilities do not extend to the
end users outsourced parties including domain registers, web hosts,
web developers, programmers or merchant gateways. We may at our
sole discretion.
